The Protection of Traditional Knowledge in Costa Rica and the Relationship with Intellectual Property Rights: International / National Progress and Perspectives (CISDL 2018)

This article aims to analyze the main provisions contained in the Biodiversity Law of Costa Rica, related to access to genetic and biochemical resources, the protection of traditional knowledge associated with them and intellectual property rights. After a brief explanation of the background and process that led to the drafting of the Biodiversity Law, the main rules related to the aforementioned topics and their state of implementation are studied. The most relevant provisions contained in the Nagoya Protocol on Access to Genetic Resources and Benefit Sharing are mentioned. Some initiatives developed by the competent authorities for the determination of sui generis community intellectual rights provided for in the Law are described.
