Implementation of Access and Benefit Sharing and the Nagoya Protocol in Latin America and the Caribbean: The current situation, legislative and political challenges 3 years after entry into force

During the drafting process of the Convention on Biological Diversity (CBD), the negotiation of the provisions on sharing of benefits derived from the utilization of genetic resources (ABS), were conceived as necessary for the incorporation of traditional issues in the field of biodiversity (conservation and sustainable use). However, there is widespread recognition – particularly among developing countries – that full compliance with the Third Objective of the CBD (fair and equitable distribution of benefits) has yet to materialize or at least not to the extent that was expected. This paper explores the implementation of ABS measure in Latin America and the Caribbean three years following entry into force of the Protocol highlighting legislative and political challenges.
